Lightspeed Business Solutions Limited Terms & Conditions.
1. Definitions
- "LBS" means Lightspeed Business Solutions Limited
- "The client" means the company or person to whom the estimate is addressed
2. The "Terms & Conditions" apply to all contracts/ agreements between LBS and the client unless otherwise agreed in writing
3. Payment
- The client shall pay LBS for all goods/services supplied to the client. Payment terms are as follows:
- For bureau work, payment terms are 30 days from invoice date
- For software sales, payment is cash with order for new customers and 21 days from invoice date for established customers.
- VAT shall be paid by the client on all invoices in accordance with current rules and regulations relating to VAT.
- In the event of any invoices remaining unpaid for more than the relevant number of days as outlined above, LBS reserve the right to charge interest on any outstanding sums from the invoice date to the date of payment at 5% above Natwest Bank base lending rate. LBS also reserve the right not to carry out any further work until all outstanding invoices and interest is paid in full.
- Payment terms are subject to a satisfactory credit check and LBS reserves the right to vary terms until such checks have been carried out.
4. Liability
Without prejudice LBS shall not be liable for loss or damage suffered by any person or company resulting from:
- The destruction or disposal of the original documents.
- The state of originals when received by LBS.
- Faulty workmanship or delays other than those by LBS or its employees.
- Any circumstances beyond the control of LBS.
- The transit of the originals or the product.
5. Acceptance of our service
If the client does not notify LBS in writing of any errors or omissions
within 14 days of delivery, it will be deemed the client has accepted
the product.
6. Destruction of original documents
- LBS will not destroy the original documents except in accordance with this clause.
- Unless the client gives LBS notice in writing to the contrary, destruction of the original documents will begin 3 weeks after the delivery of the product to the client.
- If LBS retain the originals beyond the 3-week holding period whether at the client's request or otherwise LBS may charge the client for such storage at its usual rates
- If LBS are requested to deliver the originals to any
other person other than the client LBS reserve the right to charge for
this service
7. Price Variation
LBS may vary the prices charged to the client to take account of the following:
- Changes in prices charged to LBS for any goods/services supplied to the client or used in providing the supply.
- Any goods/services to the client other than those agreed in the quotation.
- The state or condition of the originals when received
by LBS
8. Insurance & risk
Original documents shall be at the risk of the client at all times.
